Gabrielensemble.org is wholly owned by GCE. All content on the site, including text and images, is copyrighted to GCE, with the following exceptions:

1. Biographical data: Copyright to biographical information and images for individual musicians is held by those musicians and is reproduced here with permission.

2. Some images, including some “hero” images in the banners are sourced from free or paid image download sites. Copyrights for those images belong to the original producers.

No material on this web site that is copyrighted by GCE may be copied, transmitted, or reproduced in any manner without the express written consent of GCE. Any transmission, copy, reproduction, or alteration of the material or content on this website(s) is a violation of GCE’s copyrights.

Payment Processing

All purchases on this web site are handled by PayPal, Inc. When purchasing tickets or reservations for events, once you click one of the payment buttons, you will be taken to PayPal and throughout the purchasing process you will be subject to PayPal’s applicable Terms and Conditions, Privacy Policy, and all other PayPal policies related to purchase transactions.

Tickets

Purchase

Tickets may be purchased on our web site for events that are hosted by GCE. After submitting payment information, you will receive an instant confirmation on the web site, and an order confirmation by email. If you do not receive either confirmation, or you receive any error notification on the web site, you are responsible for confirming your order by contacting GCE. GCE will not be responsible for losses if you don’t receive a confirmation, and fail to contact GCE to confirm your order.

Handling Fee

For tickets purchased via PayPal, GCE adds a handling fee per ticket. At the time of this revision, the handling fee is $2.00 per ticket.

Seating

All tickets sold on this site for GCE hosted events are general admission, first-come first-serve seating. There is no reserved seating.

Refundability

All sales are final. Tickets purchased on this site are non-refundable. However, they are transferable. All Season Concert tickets may be used for any concert in the season during which they were purchased. If you cannot attend a Season Concert for which you purchased a ticket, you may attend a different Season Concert in that Season, or offer that ticket to someone else to use. If you want to transfer your Season Concert ticket to another person, and your ticket is held at Will Call, please contact us before the event to let us know of the change.

Hazardous Weather, IPAWS, and Local Public Emergency Alerts

Unless otherwise noted on a specific event, all indoor and outdoor ticketed events hosted by GCE are rain or shine. In the event of hazardous weather or public emergency alert that results in cancellation of an event, you will be contacted by GCE about refunds, credits, or rescheduling as soon as possible. By purchasing tickets, you agree that GCE will not be responsible for delays, shutdowns, power and/or Internet outages, inconvenience, traffic, or other problems due to public hazards that would impact an event.

Other Venues

Events that include performances by GCE, but are hosted elsewhere, may be listed on this web site, but tickets for those events will not be available for purchase on this web site. If available, this web site will provide a link to such an event for users to purchase tickets. GCE will not be involved in the purchase process for those tickets.

Events hosted by other venues are not controlled by GCE, so in the event of inclement weather or public hazard alerts for outdoor events at such venues, the hosting venue should be contacted regarding cancellation, rescheduling,  and refund policies.

Claims of Infringement/DMCA

The Digital Millennium Copyright Act of 1998 (“DMCA”) provides copyright owners who believe content appearing on the Internet infringes upon their rights under U.S. copyright law a legal recourse. If you have a good faith belief that any material on our Site infringes your copyright, you (or your agent) may send us a notice requesting the content be removed. This Site may contain links to other Internet websites or resources. Since GCE does not have control over these websites or resources, you acknowledge and agree that GCE will not be held responsible for their availability, content, advertising, products, services, or other materials available on them. You also acknowledge and agree that GCE shall not be responsible or liable for any damage or loss caused or alleged to be caused by or in connection with any use of or reliance on these websites or resources, including that caused by viruses, worms, Trojan horses, defects, and other destructive electronic devices.

Use by Minors

GCE is family friendly. GCE does not post materials on the site which are harmful to children. If any such material appears on our site as the result of hacking, virus, Trojan horse, worm, defect, or any other cause, please notify us immediately so that we may remove it.

Violations

GCE may investigate any violation of these Terms, including but not limited to unauthorized use of the Site. GCE may pursue any legal action it deems necessary. The failure or delay of GCE to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If GCE determines that you have violated these Terms or other applicable law, or for any other reason, we may cancel any order, including tickets already acquired through your order. We may refuse to honor pending and future purchases made from any and all accounts we reasonably believe may be associated with you, or cancel a ticket or order associated with any person we believe to be acting with you or on your behalf.

Disclaimer of Warranties

ALL MATERIALS AND CONTENT ON THIS SITE ARE PROVIDED “AS IS” AND NO GUARANTEES OR WARRANTIES OF ANY KIND ARE EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, NON-INFRINGEMENT AND FITNESS FOR A PARTICULAR PURPOSE. GCE MAKES NO WARRANTY THAT OUR SITE OR SERVICES PROVIDED WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. GCE SHALL HAVE NO RESPONSIBILITY FOR, AND HEREBY DISCLAIMS ALL LIABILITY ARISING FROM, THE ACTS OR OMISSIONS OF ANY THIRD PARTY SERVICE PROVIDER. THE FOREGOING LIMITATIONS SHALL ONLY APPLY TO THE FULL EXTENT ALLOWED BY LAW.

Indemnity

Should you bring a claim against GCE related to your use of the Site or your violation of these Terms, you agree to indemnify, defend, and hold GCE, any of our affiliates, and any of our officers, directors, employees, and agents, harmless from and against all claims, damages, losses, and expenses of any kind (including reasonable legal fees and costs). GCE reserves the right to take exclusive control and defense of any claim, and you agree to cooperate fully with GCE in asserting any defenses available.

Choice of Law

The terms of this agreement shall be governed by and in accordance with the laws of the State of Pennsylvania.

Dispute Resolution

In the event of any dispute or controversy arising from the use of this Site, the parties agree to first submit all issues to mediation under the procedures of the American Arbitration Association. In the event that mediation fails to resolve all issues, the parties shall submit all remaining issues to arbitration under the procedures of the American Arbitration Association; the prevailing party shall be entitled to reasonable attorneys’ fees and expenses in accordance with those procedures. The venue of the mediation or arbitration shall be determined such that the party who commences the dispute resolution shall do so in the city where the other party has its principal place of business.

Invalid Provisions

Should any provision of these Terms be found by an arbitrator or court of proper jurisdiction to be invalid, the parties agree that the arbitrator or court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of these Terms shall remain in full force and effect.
